Email Compliance Policy

[SELLF-X] -- This policy governs all email outreach sent through SELLF-X. SELLF LLC complies with CAN-SPAM (U.S.), CASL (Canada), and GDPR (EU/UK) for email communications.

1. Regulatory Framework

CAN-SPAM Act (U.S.)

Governs commercial email to U.S. recipients. Requires accurate sender identification, honest subject lines, opt-out mechanisms, and physical address disclosure.

CASL (Canada)

Canada's Anti-Spam Legislation. Requires express or implied consent before sending commercial electronic messages to Canadian recipients.

GDPR / UK GDPR (EU & UK)

Requires a lawful basis for processing personal data used in email outreach. For marketing emails, explicit consent is typically required.

CAN-SPAM Penalties

Violations carry penalties of up to $51,744 per email under current FTC enforcement guidelines.

2. CAN-SPAM Requirements (U.S.)

All commercial emails sent through SELLF-X must comply with the following CAN-SPAM requirements:

Accurate Header Information

The 'From,' 'To,' 'Reply-To,' and routing information must accurately identify the person or business sending the email. You may not use deceptive headers.

Non-Deceptive Subject Lines

Subject lines must accurately reflect the content of the message. Misleading subject lines (e.g., 'Re: Your account' when there is no prior relationship) are prohibited.

Identification as an Advertisement

If the primary purpose of the email is commercial, it must be clearly identified as an advertisement. SELLF-X's outreach templates include compliant disclosure language.

Physical Mailing Address

Every commercial email must include a valid physical postal address. This may be a current street address, a P.O. Box, or a private mailbox registered with a commercial mail receiving agency.

Clear Opt-Out Mechanism

Every email must include a clear and conspicuous explanation of how the recipient can opt out of receiving future emails from you. The opt-out mechanism must be easy to use and must not require the recipient to pay a fee or provide information beyond their email address.

Honor Opt-Outs Promptly

Opt-out requests must be honored within 10 business days. You may not send additional commercial emails to a recipient after they have opted out, and you may not sell or transfer their email address after opt-out.

3. CASL Requirements (Canada)

For emails sent to Canadian recipients, you must have either express consent (explicit opt-in) or implied consent (existing business relationship within the past 2 years, or a published email address with no opt-out notice).

Express consent must be obtained through a clear opt-in mechanism and must specify:

+The name of the person or organization seeking consent
+The mailing address and either a phone number, email address, or web address
+A statement that the person can unsubscribe at any time

CASL penalties can reach CAD $10 million per violation for organizations. SELLF LLC strongly recommends obtaining express consent for all Canadian recipients regardless of implied consent eligibility.

4. Required Email Footer

Every commercial email sent through SELLF-X must include a footer containing:

[Physical Mailing Address]

[City, State ZIP]

You received this email because [reason for contact].

To unsubscribe, click here: [unsubscribe link] or reply with "UNSUBSCRIBE" in the subject line.

SELLF-X automatically appends a compliant unsubscribe link to all outreach emails. You must configure your physical address in your account settings for it to appear correctly.

5. Prohibited Email Practices

xSending to purchased, rented, or harvested email lists without documented prior consent
xUsing deceptive or misleading subject lines
xFalsifying header information or sender identity
xSending emails that impersonate another person, brand, or organization
xContinuing to send emails after receiving an opt-out request
xSending emails containing malware, phishing content, or deceptive links
xSending emails related to prohibited industries (illegal substances, unlicensed firearms, adult content, etc.)
xUsing SELLF-X to send bulk unsolicited email (spam)

6. Transactional vs. Commercial Email

CAN-SPAM distinguishes between transactional and commercial emails. SELLF LLC's own system emails (twin-ready notifications, billing receipts, account alerts) are transactional and are exempt from CAN-SPAM's opt-out requirements. However, they must still contain accurate header information and physical address.

Emails sent through SELLF-X's outreach features on your behalf are commercial emails and are subject to all CAN-SPAM requirements described in this policy.

7. User Responsibility

You are the sender of record for all emails sent through your SELLF-X account. SELLF LLC provides the platform and delivery infrastructure. You are solely responsible for: obtaining consent, maintaining suppression lists, ensuring your physical address is accurate, and complying with CAN-SPAM, CASL, GDPR, and any other applicable law in your recipients' jurisdictions. SELLF LLC is not liable for regulatory fines or legal claims arising from your email outreach activity.
